Terms and Conditions
These terms and conditions help to keep our website a safe place to trade and set out the full extent of any agreement reached between you and ourselves in connection with this site. You should understand that by placing an order, you accept the following terms and conditions:
General
1 The owner of this website is Leamington Shopmobility (Trading) Ltd. (From here on in referred to as LST). Our address is Shopmobility Unit, Level 4, Royal Priors Car Park, Park Street, Leamington Spa, CV32 4XT United Kingdom.
2. Your contract for purchases made through this website is with Leamington Shopmobility (Trading) Ltd.
3. You agree that e-mail can be used as a long-distance means of communication
4. No contract for the sale of any product will subsist between you and LST (unless and until LST accepts your order by way of shipment). For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England and you and LST irrevocably submit to the non-exclusive jurisdiction of the English Courts.
5. You undertake that all details you provide to LST for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own, and that there are sufficient funds to cover the cost of the goods or services ordered.
6. If there are any changes to the details supplied by you it is your responsibility to inform LST as soon as possible.
7. Your statutory rights are not affected (in particular see below as to your rights to withdraw from the contract) but otherwise all purchases are non-exchangeable, non-refundable and non-transferable.

LST is against 'spamming' - the practice of sending unsolicited emails in large numbers and repeatedly to individuals with whom the sender has had no previous contact or who have declined to receive such communications. As such we do not pass on your details to anyone else and do not send out mail shots ourselves. If the equipment you have purchased from us requires servicing, we will write to you and inform you when the service is due.

We will not knowingly collect, use or disclose personal data from any individual under 18 years of age without obtaining prior consent from a parent or guardian through direct, offline contact. We abide by laws designed to protect children.

Returns, Replacements, Refunds and Cancellation Policy
For all returns, please get in touch using the contact form in "Contact Us".
LST are happy to accept returns in the following circumstances:
1. If goods you ordered arrive and you change your mind about their suitability or they arrive in a damaged condition. The unwanted product must be returned in the condition in which they were received, along with packaging, within 7 days of receipt. When the goods are back with us and been checked, we will refund you in full or a replacement will be dispatched at your request. If a refund is required your payment card will be credited within 28 days.
2. You may cancel your order for any reason within 7 days of it being ordered under Distance Selling Regulations 2000.
3. If an item develops a fault through proper use within its warranty period. Please contact us in this eventuality and we will be happy to provide a replacement.
Please email us using”Contact Us” above if would like to arrange a return for any of the reasons listed here.
Exceptions:
When the products have been made or customised specifically for you; or the products can not be resold for hygiene reasons e.g. toileting and incontinence items or other items involving intimate contact.- we regret that no refunds or replacements can be issued.
None of the above affects your statutory rights.
LST complies with The Consumer Protection Distance Selling Regulations 2000.
Delivery Policy
1. Credit and Debit cards are debited before items are shipped by us. All prices exclude sales taxes / value added taxes (where applicable) unless otherwise stated, and any additional charges made for shipping are shown at point of sale and are calculated on the packaged weight of the product. There are a number of delivery options selectable at the checkout depending on your location and the product weight. We will use the method you select.
2. Every purchase you make shall be deemed performed in the United Kingdom of Great Britain and Northern Ireland. English law shall govern every aspect of contractual agreement concerning purchases made from this website.
3. LST aims to arrange shipment of all items within 14 days of receiving your order (together with your exemption form if appropriate). Your order may be delayed if the item is not in stock with our suppliers. In this event we will contact you to inform you of this and offer a refund. Some items may be unavailable and any current stock status is approximate. LST are not able to supply dates our suppliers may get an item in stock.
5. Our standard Returns Policy applies to all purchases from this website.
6. Any period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. Please note that on occasion it may be necessary your goods may be sent to you in installments.
7. Title to any product ordered will pass to you once LST has received payment in full for that product
8. If your delivery address is outside of the United Kingdom you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; LST advises our customers to contact their local customs office for further information.
9. Please note that when shipping products internationally you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
10. From time to time LST may engage a 3rd party to fulfill orders, a contract for the sale of these products will be made between the 3rd party supplier and yourself.
11. If the method of delivery you have selected includes tracking information we will pass on this information within 24 hours of the goods being handed to the carrier.
Liability
1. This Liability section applies only to the extent permitted by law. For the avoidance of doubt, LST does not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from our negligence or willful default, or that of our employees, agents or subcontractors or (b) fraudulent misrepresentation.
2. LST does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services without notice.
3. LST does its best to correct errors and omissions as quickly as practicable after being notified of them.
4. To the fullest extent permitted by law, LST are providing this website and its contents on an “as is” basis and make no (and expressly disclaims all) representations or warrantees of any kind, express or implied, with respect to this website or the information, content, materials or products included in this website, including, without limitation, warrantees or merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that that the information accessible in this website is current or complete.
5. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, LST shall, at our own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. Nothing in this clause affects your statutory rights.
6. LST does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of this website or for any products or services purchased from us.
7. LST will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim.
Miscellaneous
1. These terms and conditions are subject to the laws and exclusive jurisdiction of the United Kingdom of Great Britain and Northern Ireland.
2. It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Similarly it is a crime to submit a false VAT exemption declaration. LST track the electronic 'fingerprints' of every order placed on our website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.
3. LST may amend these terms and conditions from time to time, and place the new version on this website. All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms.
4. These terms and conditions shall apply when LST accept your order by e-mail confirming that it has received payment in full for all the goods you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between ourselves and yourself relating to your purchase.
5. LST advise that you print off and keep safe a copy of these terms and conditions once your order has been accepted.
6. You are advised to read (and are responsible for reading) all information on this website fully.
7. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain
